The present writ petition has been filed seeking a direction to the respondent/MCD to inspect the ongoing excavation activity being carried out in a portion of the property bearing no. 2109, Ahata Mir Bukhari, Turkman Gate, Delhi, and take action in accordance with law. 2.

It is stated that the subject property is situated immediately behind the petitioner's property at 2139, Ahata Mir Bukhari, Turkman Gate, Delhi110002. It is the case of the petitioner that the excavation activity being carried out in the subject property is affecting the property of the petitioner. major mishap.

Counsel appearing on behalf of the respondent/MCD has handed over in the Court a work stop notice dated 18th May, 2026, which has been issued to SHO, P.S.: Chandni Mahal, stating that the aforesaid construction is without any sanction plan and therefore, should be stopped forthwith. 3.1.

The same is taken on record.

In view thereof, the present writ petition is disposed of, while directing the respondent/MCD to take appropriate action in accordance with law, in an expeditious manner.

In the event any further grievance arises, the petitioner shall be at liberty to avail remedies in law.

All rights, contentions and legal remedies of owner/occupier/private respondents are kept open.
