O R D E R

% 04.10.2016 CM Nos. 32208/2016 (for restoration) & 32209/2016 (for delay) These applications seek restoration of the petition which was dismissed in default on 19.07.2016 and condonation of delay, respectively. There is no opposition to the relief sought. For the reasons mentioned in the applications, the delay is condoned and the petition is restored to its original number and seniority.

The applications stand disposed off accordingly. W.P.(C) 13780/2004 The learned counsel for the parties submit that the case has been settled amicably vide Settlement Agreement dated 29.08.2016, whereby the workman is to be paid total amount of Rs.5,00,000/-. A sum of Rs.1,00,000/- has already been paid.

For the balance amount of

Rs.4,00,000/-, a sum of Rs.50,000/- in cash and a banker's cheque amounting to Rs.3,50,000/- bearing No.972975 dated 01.09.2016 drawn on State Bank of India, Punjabi Bagh, New Delhi in favour of respondent No.2 are handed over to him, which have been acknowledged by respondent No.2 by a receipt. Copy of the aforesaid Settlement Agreement dated 29.08.2016 is taken on record.

The learned counsel for the workman states upon instructions of the latter, who is present in Court, that no further lis whatsoever survives between the parties.

In the circumstances, the petition is disposed off as being settled in terms of the aforesaid Settlement Agreement.
