1. The hearing has been conducted through Video Conferencing.

2. The daughter of the petitioner is suffering with 3mm calculus of HU250 at the interpole of her right kidney and she is suffering with Tuberculosis and getting treatment of it from Government hospital.

3. The petitioner submits in view of Covid-19 pandemic situation, he intends to look after her ailing daughter as there is no other male member in the family except one son who has just attained the age of 18 years and unable to look after his elder sister.

4. The daughter of the petitioner is suffering from Tuberculosis has been verified by the police and the order dated 27.07.2020 passed by the learned Session's Court also notes the factum of his daughter having 3mm calculus.

5. In the circumstances, considering the quantity of the heroin recovered from the petitioner (just above the small quantity) and also that his daughter is being suffering from various ailments, the petitioner is hereby granted interim bail for a period of 45 days from the date of his release on his executing a personal bond of Rs.20,000/- to the satisfaction of the Jail Superintendent/Duty MM. The surety of the like amount shall be SHARMA

furnished by the petitioner within a week of the learned Trial Court resuming its normal functioning. However, if the period of interim bail expires before the learned Trial Court starts/resumes its normal functioning and the applicant surrenders, then there shall be no need to furnish the surety before it. The petitioner is also directed to provide his contact number/address to the SHO of police station Shalimar Bagh, Delhi as also he shall keep open his location application in his mobile at all time.

6. The petition stands disposed of in above terms.
