The present writ petition has been filed seeking a direction to respondents to demolish the unauthorized construction being carried out at Flat No. B-33, SFS Flats, Sheikh Sarai Phase-1, New Delhi-1100017 (hereinafter 'subject property').

Counsel appearing on behalf of the respondent-MCD, on advance notice, submits that unauthorized construction in the subject property has been booked and a show cause notice has been issued on 19th May, 2026. Further, a work stop notice has also been issued to the concerned SHO on the same date, calling upon the SHO to stop unauthorized construction. 2.1.

Both the aforesaid documents have been handed over in Court and are permitted to be taken on record.

In view thereof, the present writ petition is disposed of, while directing respondent-MCD to take action in accordance with law and to ensure that no further unauthorized construction is carried out. 4.

In the event, the petitioner has any further grievance, the petitioner would be at liberty to take appropriate remedy in accordance with law. 5.

All rights, contentions and legal remedies of private respondent no.3/ owner/ occupier are kept open.

Pending applications stand disposed of.
