Application is disposed of.

W.P. (C) 5609/2020 & C.M. Nos. 20325/2020 & 20327/2020 Petitioner herein is employed with Tirath Ram Shah Hospital which according to the learned counsels for the parties is admittedly under the aegis of the Government of NCT of Delhi.

Since the Petitioner is employed with the Hospital, which is under the control and supervision of the Government of NCT of Delhi and the issue raised in the Petition is a 'service matter', this Court has no jurisdiction to entertain the present petition in view of Section 14 (1) of the Administrative Tribunals Act, 1985, and the judgement of the Constitution Bench in the

case of L. Chandra Kumar v. Union of India and Others, (1997) 3 SCC 261.

At this stage, Mr. Jha counsel for the Petitioner seeks to withdraw the present Petition, with liberty to approach the Central Administrative Tribunal.

Present Petition, along with accompanying Applications, is accordingly disposed of, granting the liberty, as prayed. JYOTI SINGH, J SEPTEMBER 15, 2020/yo
