% 27.02.2017 Learned counsel for petitioner is aggrieved by the illegal and unauthorised construction which as per the petitioner has been raised afresh (after demolition having been effected on 24.3.2015) by respondent no.2 in Flat No.22-B, Ist Floor, Pocket-A, Sukhdev Vihar, Delhi.

On advance notice learned counsel for respondent no.1 has put in appearance. Her instructions are that pursuant to a second demolition order the demolition had again been effected qua the unauthorised encroachment by respondent no.2 on 30.01.2017. Her further submission is that all necessary actions which have already been initiated shall be completed in accordance with law. This statement of counsel for respondent no.1 is noted. Learned counsel for respondent no.1 further points out that this appears to be an abuse of the process of the Court as inter se suits are pending between

petitioner and respondent no.2. There are two suits pending inter se the parties (fact admitted by the petitioner). Submission being that the issue raised in this petition can well be taken care of in the inter se suits between the parties. This submission is noted. Noting the stand of respondent no.1 no further orders are called for in this petition. Petition disposed of.
