This is second bail application filed by accused/applicant in case FIR No. 149/2024 of Police Station Vasant Kunj, South for offence under Section 370/354B IPC and Section 4/5 ITP Act. 2.
The earlier application of the accused/applicant bearing no. BAIL APPLN 2991/2024 was disposed of on 22.08.2024 by a coordinate bench of this Court. On being called upon to address change in circumstances, learned counsel for accused/applicant submitted that the change in circumstances is that the trial is not proceeding further and her application for discharge is not being decided. Learned counsel for accused/applicant specifically submits that it is the trial court which insisted that a discharge application should be filed in this case and learned counsel was not agreeable but filed the same. 4.
Under these circumstances, learned counsel for accused/applicant seeks permission to withdraw this application with liberty to approach the this Court again in case of change in circumstances. 5.
Accordingly, the application is dismissed as withdrawn with liberty as sought.
