The present writ petition has been filed seeking a direction to respondent no.1/ MCD to demolish the unauthorized construction being raised by respondent no. 3 at Plot no.50, Khasra No. 28/21, situated in the Revenue Estate of Village Kakrola, Colony known as Bharat Vihar, DBlock, Kakrola known as Bharat Vihar, D-Block, Kakrola, New Delhi ('subject property').

Earlier, a writ petition being W.P. (C) 16261/2025 was filed by the petitioner, which was disposed of by this Court, vide order dated 3rd February, 2026, with the following directions: The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

A status report has been handed over in Court on behalf of respondent no.1/MCD.

1.1 The same is taken on record.

Along with the status report, MCD has enclosed a speaking order dated 2nd February, 2026.

Mr. L.B. Rai, counsel appearing on behalf of respondent no.3, submits that the demolition exercise has been carried out this morning itself.

In view thereof, Ms. Tanya Agarwal, counsel appearing on behalf of the petitioner submits that the present writ petition has become infructuous and she does not wish to press it any further. 5.

Accordingly, the petition stands disposed of. 6.

Needless to state, all legal rights and remedies of the parties are kept open."

The grievance of the petitioner is that after the said order was passed, fresh construction is being carried out by respondent no.3 at the subject property.

Mr. Abhinav Singh, counsel appearing on behalf of the respondent no.1/ MCD submits that the fresh construction is being raised by respondent no.3, which has been booked and a show cause notice and a work stop notice has been issued on 19th May, 2026.

In view thereof, the present writ petition is disposed of, while directing respondent no.1/ MCD to take appropriate action in accordance with law.

In terms of the work stop notice issued by the respondent no.1/ MCD, the respondent no.2/ SHO, P.S. Dwarka (North) shall ensure that no unauthorized construction is carried out at the subject property. 7.

In the event, the petitioner has any further grievance, he would be at liberty to take appropriate remedy in accordance with law. 8.
