The petitioner has filed the present petition, inter alia, seeking bail in FIR No. 854/2015 under Sections 302/201 of the IPC, registered with PS New Usmanpur.

Ms Chauhan, learned APP states that evidence of all witnesses for the prosecution is already over. She states that the matter is listed for recording of the statement of the petitioner under Section 313 of the Cr.P.C. 3.

The learned counsel appearing for the petitioner states that the matter is now listed on 28.11.2019 and the trial is almost over. It is also seen that the prosecution's case against the petitioner is that he was the last person seen with the deceased. The deceased and the petitioner had gone out together but only the petitioner had returned. The prosecution further claims that the clothes worn by the petitioner were also recovered. 4.

Considering the stage of the case, this Court does not consider it apposite to allow the present petition. However, the Trial Court is requested

to dispose of the case as expeditiously as possible. 5.

The petition is dismissed.
