This application is, accordingly, disposed of. W.P.(C) 5318/2019 Vide the present petition, the petitioner seeks direction thereby directing the respondent-Bank to treat the petitioner as a pension optee and consequently, inform the petitioner the amount that is required to be refunded by the petitioner including interest thereon and on such refund, grant the petitioner the entire arrears of pension with interest and continue to pay the pension on monthly basis that is due to him. For the aforesaid purpose, the petitioner has sent a legal notice dated 19.02.2019 through his Advocate, however, till date, no decision is taken on the said legal notice.

Keeping in view the reasons and the averments made in the instant

petition, I hereby dispose of the present petition directing the respondent Bank to take a decision on legal notice dated 19.02.2019, which is Annexure P-13 at page 63, within two months from the receipt of this order. The decision shall be communicated to the petitioner within one week thereafter.

If the petitioner is still aggrieved, he may challenge the same before the appropriate Forum.
