By way of this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks regular bail in connection with FIR No. 268/2024 dated 13.03.2024, registered at Police Station Paschim Vihar West, Outer District, Delhi, under Sections 306/363/366/376 of the Indian Penal Code, 1860 and Sections 4 and 6 of the Protection of Children from Sexual Offences Act, 2012. 2.

After some hearing, Mr. Pawan Kumar, learned counsel for the applicant, seeks permission to withdraw the present application. However, he submits that the applicant has already remained in judicial custody for over two years, and that the Forensic Science Laboratory ["FSL"] report with regard to the analysis of the uterus of the deceased is still pending. The Call Detail Records and Customer Application Forms of the deceased and her sister are also awaited. learned Trial Court, while reserving liberty to the applicant to move the learned Trial Court afresh in the event of any inordinate delay in the progress of the proceedings.

The application, alongwith the pending application, is dismissed as withdrawn in terms of the above submissions.

The prosecution is directed to expedite the FSL report and any other evidence that it seeks to place before the learned Trial Court, by way of a supplementary chargesheet.

It is clarified that this Court has not expressed any opinion on the merits of the case, and all rights and contentions of the parties, including in any future application, are left open.
