Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023/Section 482 of the Code of Criminal Procedure, 1973 has been filed on behalf of the Petitioner, Mr. Jitu seeking quashing of FIR bearing No. 182/2020 dated 06.10.2020 under Section 376/506 of the Indian Penal Code, 1860 and Section 6 of POCSO Act, registered at Police Station Hauz Qazi, New Delhi and the consequent proceedings emanating thereto. 2.

Issue Notice.

got registered. They have got married on 31.10.2020 and residing together. They have two children from their wedlock. Hence, the quashing of the said FIR is sought.

Learned Prosecutor for the State has drawn the attention to the Order dated 18.03.2021 wherein similar quashing Petition on same grounds were filed but was not accepted by this Court.

Once, the Court had already declined to quash the FIR, there is no fresh ground made out for quashing the FIR No. 182/2020 dated 06.10.2020 under Section 376/506 IPC and Section 6 of POCSO Act, registered at Police Station Hauz Qazi, New Delhi.

The Petition is disposed of accordingly along with the pending Application.
