O R D E R
% 15.03.2018 The appellant has impugned an order dated 16.11.2017 granting him the conditional leave to defend upon depositing a sum of Rs.5,00,000/- against a claim of Rs.10,00,000/-.
The learned counsel for the appellant submits upon instructions that without going into the merits of the case, the appellant is ready and willing to deposit an amount of Rs.2,50,000/- as a conditional leave to defend. Keeping in mind the peculiar circumstances of the case, the Court deems it appropriate that the impugned amount may be modified to Rs.3,00,000/-.
The learned counsel for the respondent submits that without prejudice to his rights and contentions, the respondent has no objection to the modification of the impugned order.
With consent, the impugned order is modified to the extent that instead of Rs. 5,00,000/- a sum of Rs.3,00,000/- shall be deposited by the
appellant before the Trial Court concerned within four weeks from the date of receipt of a copy of the order as a condition for her leave to defend. The appeal, alongwith pending application, is disposed off in the above terms.
