proceedings emanating therefrom on the basis of settlement arrived at between the parties.

Issue notice. The learned APP accepts notice on behalf of the State. 5.

The petitioner and respondent nos. 2 & 3, who are the father and brother of the deceased i.e., Dinesh Saini, who unfortunately died due to some other accident on road, are present before this Court and have been identified by their counsel and Investigating Officer (IO) concerned, Police Station, Balaswa Dairy, Delhi.

Brief facts of the case are that the present FIR was registered on the statement of respondent no. 2 regarding an alleged road traffic accident, wherein on 16.09.2017 at about 2:40 AM, respondent no. 2 along with his wife and sister-in-law was travelling in a TSR bearing registration No. DL1RU2093 towards Old Delhi Railway Station. It is alleged that when the TSR reached near the Old Iron Bridge underpass, the petitioner, who was allegedly driving an i20 car bearing registration No. DL8CX8160, came from the side of Hanuman Mandir at a high speed and in a rash and negligent manner, allegedly driving on the wrong side of the road, and collided head-on with the TSR. It is further alleged that due to the impact of the collision, the occupants of the TSR as well as the TSR driver, namely Dinesh Saini, fell on the road and sustained injuries.

Thereafter, respondent no. 2 and the TSR driver were taken to the Trauma Centre for medical treatment. On the basis of the statement of respondent no. 2, the aforesaid FIR came to be registered against the petitioner. It is stated that with intervention of the respected members of the society, the parties have now amicably settled their dispute vide Memorandum of Understanding (MoU) dated 13.01.2025 and the parties are presently living together. On a query made by this Court, respondent no. 2 & 3 who have been identified by the IO, have categorically stated that they have entered into compromise out of their own free will and without any pressure, coercion or threat. It is also stated that they have already received the compensation amount as per the said Mou. Therefore, she has no objection if the present FIR is quashed.

In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9.

Accordingly, FIR bearing No. 355/2017, registered at Police Station Kashmere Gate, Delhi, for the commission of offences punishable under Sections 279/337 of IPC and all consequential proceedings emanating therefrom are quashed.

Accordingly, the petition stands disposed of. 11.
