The present petition has been filed by the Petitioner - Narender Pratap Singh under Article 226 of the Constitution of India, inter alia, seeking issuance of an appropriate writ directing the Respondent No.1- Registrar Cooperative Societies (hereinafter, 'RCS') to hold or convene the Rule 90 Committee constituted under the Delhi Co-operative Societies Rules, 2007. The Petitioner further prays for forwarding the name of Petitioner to Respondent No.2- Delhi Development Authority (hereinafter, 'DDA') for allotment of the flat.

not being placed before the Rule 90 Committee to enable allotment of the flat in favour of the Petitioner.

The Petitioner is a member of Manpower Co-operative Group Housing Society Limited (Regn. No. 435/GH), Kamayani Kunj, Plot No. 69, I.P. Extension, New Delhi - 110092 (hereinafter, 'society'). The Petitioner is stated to have got enrolled in the society on 20th December, 2023 at membership No. 159. According to the present petition, the Petitioner has paid the membership fee, the share money and the land and construction money for the said society. The verification of the Petitioner has also been done by the society. The society as also the Petitioner have appeared before the office of the RCS with all the requisite documents. 6.
The matter was then to be placed before the Rule 90 Committee. Though the matter has been approved by the Registrar himself, the Rule 90 Committee is not taking any decision in the matter. 7.
Mr. Ashish Dholakia, ld. Senior Counsel submits that the allotment is unnecessarily being delayed and hence he prays that the Rule 90 Committee be directed to take a decision in a time bound manner. 8.
Ld. Counsel for the Respondent submits that the main Counsel is unavailable.

After having seen the records and the documents filed with the present writ petition, there can be no doubt that the Rule 90 Committee needs to convene and take a decision in respect of the Petitioner for allotment of the flat in the society. Thereafter, once the decision is taken by the Rule 90 Committee, the recommendation is to be sent to the DDA for the purpose of allotment.

by 30th May, 2025 and the recommendation be sent by 15th July, 2025 to the DDA for allotment of the flat to the Petitioner. 11.
If the concerned authorities do not take action as directed herein, the Petitioner is permitted to approach this Court by way of an application. 12.
The petition is disposed of in above terms. Pending application(s), if any, also stand disposed of.
