O R D E R

% 06.09.2019 Learned counsel appearing for the petitioner submits that vide order dated 13.08.2019 passed by this Court, the petitioner was granted interim bail and he was directed to surrender before the concerned Superintendent of Jail on 02.09.2019. Learned counsel for the petitioner submits that the direction to surrender on 02.09.2019 was fixed for the reason that the matter was listed before the trial Court on 04.09.2019 for recording the statement of the prosecutrix. However, on the said date, the prosecutrix was not examined and now the matter is renotified for her evidence on 19.10.2019. Thus, learned counsel for the petitioner submits that though as per the direction of this Court, the petitioner has already surrendered on 02.09.2019, he prays that the petitioner be released on interim bail till the prosecutrix be examined by the trial Court.

Heard.

The order dated 13.08.2019 is a detailed order. On considering the submissions made by the learned counsel for the parties, this Court agreed to grant interim bail to the petitioner since the prosecutrix had not been examined. Therefore, I hereby grant interim bail to the petitioner till prosecutrix is examined on the same terms and conditions as were imposed by this Court vide order dated 13.08.2019.

The present petition is accordingly disposed of. Copy of this order be given dasti under the signatures of Court Master.
