The petitioners are the residents of a colony known as Mandakini Enclave, which is maintained and managed by the respondent no.4, i.e. Mandakini Enclave Resident Welfare Association (hereinafter 'RWA'). It is stated that the petitioners are the members and voters of the said RWA. The challenge in the present writ petition is with respect to the illegalities committed in holding the elections of the said RWA. 3.

Counsel for respondent no.4/RWA has cited judgment of a Coordinate Bench of this Court in W.P. (C) 12316/2019, titled "Balwant Singh and Ors. v. The Registrar of Societies and Ors.", wherein a similar challenge was made in respect of elections to a general body of RWA. It was held that such a challenge cannot be made in a writ petition filed under article 226 of the Constitution of India.

In view thereof, senior counsel appearing on behalf of the petitioners, on instructions from the petitioners who are present in Court, seeks to withdraw the present writ petition with liberty to invoke remedies that may be available in law.

Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberty.
