O R D E R

% 27.03.2026 By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks his 1st spell of furlough for a period of 03 weeks.

By way of the impugned order dated 05.10.2024, the petitioner's application for furlough has been declined on the ground that the petitioner had not earned the requisite 03 annual good conduct reports. 3.

Notice on this petition was issued on 24.04.2025. Status Reports dated 04.05.2025 and 10.07.2025 have been filed in the present petition. 4.

Pursuant to last order dated 23.03.2026, Mr. Sanjay Lao, learned Standing Counsel (Criminal) appearing for the State has handed-up a copy of another Status Report dated 25.03.2026 received from the jail The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

alongwith the updated nominal roll dated 25.03.2026 relating to the petitioner. The same is taken on record.

The nominal roll shows that the petitioner has served judicial custody of more than 12 years as on 23.03.2026; and has earned remission of almost 03 years. His jail conduct has been 'satisfactory'; and he has been serving as factory sahayak.

The nominal roll also shows that the petitioner was awarded a prison punishment in 2009 for being in possession of tobacco; he has served the prison punishment that was awarded to him at that stage. 7.

The nominal roll also shows that the petitioner has been granted interim bail on 04 occasions between 2005 and 2008; and parole on 03 occasions in 2010, 2011 and lastly in April - May 2024. 8.

In view of the above, Mr. Lao leaves it to the court to pass appropriate orders.

In the circumstances obtaining in the matter, and considering the petitioner's prison record, this court is persuaded to allow the present petition.

Accordingly, the petitioner - Sabar Bhatti s/o Inayat Bhatti is granted his 1st spell of furlough for a period of 03 weeks commencing from the date of his release subject to the following conditions: 10.1.The petitioner shall furnish a personal bond in the sum of Rs. 15,000/- (Rs. Fifteen Thousand Only) with 01 surety in the like amount from a family member, to the satisfaction of the Jail Superintendent;

10.2.The petitioner shall not leave the NCT of Delhi without permission of the court and shall ordinarily reside at his address as per prison records;

10.3.The petitioner shall present himself before the S.H.O., P.S.: Timar Pur every Wednesday between 11 am and 11:30 am to mark his presence. However, he will not be kept waiting longer than an hour for this purpose;

10.4.The petitioner shall furnish to the S.H.O., P.S.: Timar Pur a cellphone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switchedon at all times; 10.5.If the petitioner has a passport, he shall surrender the same to the Jail Superintendent;

10.6.The petitioner shall not indulge in any act or omission that is unlawful or that would prejudice the proceedings in pending cases, if any; and 10.7.Upon expiry of the period of furlough, the petitioner shall surrender before the Jail Superintendent.

Petition stands disposed-of in the above terms. 12.

Pending applications, if any, also stand disposed-of. 13.

A copy of this order be sent to the concerned Jail Superintendent forthwith.
