% 14.03.2017 We have heard the counsel for the parties. The present appeal is disposed of directing that the matter shall be taken up by the learned single Judge for final arguments on all issues. It is also agreed by the learned counsel for the parties that it is the plaintiff who will begin arguments. We are directing that this matter be listed before the learned single Judge in the first instance on 16.03.2017 for fixing the date(s) for arguments. We request the learned single Judge to list the matter at the earliest inasmuch senior citizens are involved in this suit. We also direct that the learned single Judge shall hear the matter without being influenced by the observations made in the impugned order and it shall be open to all the parties to raise arguments on all issues.

The learned counsel for the appellant has fairly stated that he wishes to withdraw all grounds/averments made in the memorandum of appeal with regard to the manner of conducting the case by the learned single Judge. The same stand withdrawn. The learned counsel for the respondents are not pressing for costs and therefore the direction with regard to costs is set side.
