% 27.05.2025 1.

This hearing has been done through hybrid mode. 2.

The present petition has been filed under Article 226 of the Constitution of India, inter alia, seeking release of the goods detained by the Respondents vide detention memo dated 17th March 2025. 3.

The case of the Petitioner is that the detention memo has been issued under Section 110 of the Customs Act, 1962 without any basis and the Directorate of Revenue Intelligence (hereinafter, 'DRI') and Customs Department are not even releasing the goods for warehousing. 4.

On the last date of hearing i.e., 24th April, 2025, after hearing the parties, the Court had passed the following directions: "8. Clearly, there is a gap in communication between DRI and Customs Department. Once the DRI has given a no objection for warehousing, Customs Department cannot delay the permission The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. to warehouse the goods that too for almost a month as is seen in the present case as the same would involve huge demurrage costs to the Petitioner.

9. Accordingly, let Mr. Ojha, ld. Senior Standing Counsel take instructions from the Customs Department, Nhava Sheva Port, Maharashtra on an urgent basis as to why the goods are not being permitted to be warehoused.

10. In the meantime, let the CRCL also give its report within a week so that the decision can be taken by the DRI on the question of further detention/seizure.

11. If the goods are not permitted to be warehoused in the next ten days or so, the Petitioner is free to move an application before this Court.

12. Let the status report be placed on record by the Respondents by the next date of hearing."

5.

Today, ld. Counsel for the Petitioner submits that the detained goods have been released and no further relief has been sought by the Petitioner.

6.

Accordingly, the petition, along with pending applications, is disposed of in the above terms.
