O R D E R

The present bail application has been filed on behalf of the petitioner seeking regular/interim bail in FIR No. 270/2019 registered under Sections 406/409/420/120B IPC at Police Station Economic Offences Wing, Delhi, on the ground that the petitioner is suffering from multi-system ailments. 2.

A Medical Status Report of the petitioner was requisitioned and the same has been placed on record alongwith the forwarded letter dated 08.09.2020, issued by Dy. Superintendent, Central Jail No. 11, Mandoli, Delhi.

The Medical Status Report reads as follows:- "1. Pt/inmate is a known case of Multisystem ailments for which he is being regularly followed at the Jail OPD and provided first line of treatment.

2. His multisystem ailments include: Hypertension, Dyslipidemia and swelling in the right inguinal region and on and off blood in the urine.

3. Although he is being managed in the Jail OPD for the above mentioned ailment, his surgical related issues needs workup at the higher referral centre since these cannot be surgically treated at the level of Jail OPD.

4. Also his issue related to swelling and the pain in the inguinal region has got further severe as pt/inmate has complained that the pain has started involving both of the testes.

5. Therefore pt/inmate needs multireferrals especially in the surgery OPD at the earhest for further analysis of the issue.

6. Also it shall be difficult to pursue multiple referrals in continuation because of the restrictions imposed by the Pandemic situation."

Learned counsel for the petitioner submits that although the petitioner has been arrested in 13 cases however, out of those 13 cases, the petitioner has been released on interim bail in 8 cases and in 4 cases, he has been released on regular bail.

The Status Report has been placed on record, wherein it has been confirmed that the petitioner has been released on either on interim/regular bail in all those cases.

Keeping in view the medical condition of the petitioner, the petitioner is admitted to interim bail for a period of 10 weeks, on his furnishing a personal bond in the sum of Rs.1,00,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/Duty MM and subject to the following conditions :- (i) The petitioner shall not get in touch with the prosecution witnesses directly or indirectly and shall not make any effort to tamper with the evidence.

(ii) The petitioner shall remain available on his mobile number i.e., 9899107021, which he undertakes to keep operational during the period of his interim bail.

(iii) The petitioner shall further remain in touch telephonically with SI Pawan, P.S. EOW on his mobile number: 9971910850 on every Monday and Friday during the period of his interim bail.

(iv) The petitioner shall surrender at the expiry of his interim bail before the concerned Jail Superintendent. (v) The petitioner shall not leave the NCR without prior intimation to the concerned I.O.

With the above directions, the bail application is disposed of alongwith pending application.

A copy of this order be communicated to the concerned Jail Superintendent electronically.
