The present petition alleges unauthorised construction and misuse of the property bearing No.2747/1, Ranjit Nagar, South Patel Nagar, New Delhi-110008.

It is submitted by learned counsel for the petitioner that the unauthorized construction is in the form of illegal construction beyond the sanctioned plan and also on account of encroachment on public road. 3.

Mr. Sabharwal, learned counsel who appears for respondent no.1/MCD, submits that the property in question shall be inspected by the MCD in the presence of the petitioner to verify as to whether any unauthorized construction/misuse subsists therein or not, and if so, appropriate action in accordance with law shall be taken expeditiously. 4.

found to be ongoing, appropriate steps shall be taken to bring the same to an immediate halt.

Taking the aforesaid statement on record and binding the respondent no.1/MCD thereto, the present petition is disposed of. 6.

In case there is deficiency in the action taken by the respondent no.1/MCD, the petitioner shall be entitled to avail appropriate remedies in accordance with law.
