The present writ petition has been filed seeking a direction to the respondent/MCD, not to take coercive steps or carry out demolition in respect of subject property bearing no. Plot no. 224, Khasra no 148, Rajpur Khurd Extension Colony, Delhi (hereinafter 'subject property'). 2.
This Court, vide order dated 8th August, 2025 in CONT.CAS(C) 902/2025 and W.P.(C) 6615/2025 directed the respondent-MCD to take requisite action in accordance with law, against the subject property. further submits that an LPA against the aforesaid judgment dated 8th August, 2025 has been filed by the petitioner, being LPA 98/2026, which is pending before the Division Bench.

Mr. Nath, counsel appearing on behalf of the respondent-MCD submits that a demolition order in respect of the subject property has already been passed on 21st April, 2025 and 16th June, 2025 and the respondentMCD is taking action in terms of the said orders. 4.
The contention of the petitioner no.1 is that she has purchased Flat No. C-2, on the Second Floor of the subject property on 16th April, 2026, vide an Agreement to Sell (Annexure P-1 to the writ petition). 5.
Mr. Chadha, Senior Advocate appearing on behalf of the petitioners submits that the petitioners are not aware of the aforesaid demolition orders. 6.
Counsel for the respondent-MCD submits that the demolition orders were duly supplied to the owners/occupiers of the subject property at the relevant time.

Without prejudice to the aforesaid contention of the respondent-MCD, copies of the demolition orders have been handed over in Court to counsel for the petitioners.

Having heard counsel for the parties, the present writ petition is disposed of, while giving liberty to the petitioners to invoke the statutory remedy of appeal within a period of ten (10) days 9.
For a period of ten (10) days, no coercive action shall be taken against flat C-2 on the Second Floor of the subject property, in respect of which an Agreement to Sell in favour of the petitioner no.1 has been filed as Annexure P-1 to the present petition.
