The present writ petition has been filed seeking setting aside of the demolition order dated 23rd January, 2026 (Annexure P/1) and the vacation notice dated 20th February, 2026 (Annexure P/2) issued by the respondent no.1/MCD.

It is the contention of the petitioner that the demolition order has been passed without giving any show cause notice or an opportunity of hearing to the petitioner.

Counsel for the petitioner submits that the demolition order does not give any details of the excess deviation carried out by the petitioner. He submits that if the petitioner is given those details, the petitioner would himself carry out the demolition, if required. Accordingly, the present writ petition is disposed of while directing the respondent no.1/MCD to provide the details of the deviation/variations carried out by the petitioner against the sanctioned building plan. 4.1 The said details shall be provided within three (3) weeks from today. 5.
Upon the aforesaid details being provided to the petitioner, the petitioner shall be given 15 days' time to invoke appropriate remedies against the same.

Pending application also stands disposed of.
