Petition under Article 226 of Constitution of India read with section 482 of the Code of Criminal Procedure 1973 has been filed with the prayer to direct Respondent No. 2 to initiate criminal prosecution against the various companies and its Directors as detailed in the Para 1 for the contraventions of various provisions of Companies Act and other legal proceedings.

It is submitted in the Petition that the Petitioner had lodged a Complaint with Registrar of Companies on its portal vide SRN No. J00089767 dated 11.01.2024 with CC to Ministry of Corporate affairs. The said Complaint was duly received by the Registrar of Companies and a reply email was received by the Petitioner from the official email id of the Registrar of the Companies.

The reminder has been given by the Petitioner to ROC via email w.r.t Complaint against companies and their Directors. been received from the Registrar of Companies about his personal examination nor Registrar of Companies has initiated prosecution for the contravention of the provisions of Companies Act, 2013 against the offenders companies and its Directors as mentioned in the Complaint. Hence, the Petition has been filed for issuance of directions to ROC as detailed above.

Learned Counsel for Union of India has appeared and submitted that he has recently been marked with this case. He further submits that he would abide by whatever directions are given by this Court. Submissions heard and record perused.

By way of the present Petition, only criminal prosecution is sought against the various companies in terms of the Complaint dated 11.01.2024. The relief as sought is not tenable under the Writ jurisdiction of this Court. The Petitioner is at liberty to follow the appropriate procedure in accordance with law.

The Petition is accordingly disposed of.
