This is an application filed on behalf of the petitioner under Section 439 of the Code of Criminal Procedure, 1973 for the grant of regular bail.

Learned counsel for the petitioner submitted that the matter has been settled between the parties vide Settlement Deed dated 4.5.2019.

Learned counsel for the petitioner submitted that the petitioner undertakes to remain bound by the terms and conditions of the Settlement Deed dated 4.5.2019, which is now exhibited as P-1. Learned counsel for the petitioner further submitted that he has given this submission on instructions from the petitioner and the same may be accepted as an undertaking on behalf of the petitioner.

Learned counsel for the complainant, in view of the Settlement Deed dated 4.5.2019 (Ex.P-1), submitted that he has no objection in case the bail is granted to the petitioner, subject to the condition that the petitioner shall comply with the terms and conditions of the Settlement Deed (Ex.P-1) 5.

In view of the submissions of the learned counsel for the parties, the undertaking given by the learned counsel for the petitioner is accepted as an undertaking on behalf of the petitioner, who shall remain bound by the same. 6.

Learned counsel for the petitioner submitted that the petitioner was granted interim bail vide order dated 21.5.2019 till today and regular bail may be granted to him as no fruitful purpose would be served by keeping him in custody. 7.

Accordingly, in view of the aforesaid circumstances, I deem it appropriate to grant the petitioner regular bail in this matter, subject to his furnishing a personal bond in the sum of Rs.25,000/-, with one surety of the like amount to the satisfaction of the Trial Court. It is directed that the petitioner shall remain bound by the terms and conditions of the Settlement Deed dated 4.5.2019. In case of failure to comply with any terms and conditions or dishonour of any cheque, the complainant may move an application for passing appropriate orders, as per law.
