1. At the hearing on 19th May, 2016, the Petitioner had stated that in case the Respondent will vacate the premises, the Petitioner is prepared to give reasonable time.
2. Today, on instructions, it is stated by Ms. Anju Bhattacharya, learned counsel for the Respondent that the Respondent will vacate the premises and hand over peaceful and vacant possession thereof on or before 31st March, 2017. A responsible officer of the Respondent will file an affidavit to the above effect not later than two weeks from today.
3. In view of the above statement, learned counsel for the Petitioner states that the Petitioner is giving up its claim for mesne profits and damages.
4. It is understood that for the period till it vacates the premises, the Respondent will continue to pay the Petitioner the charges for the O.M.P. (COMM) 27/2016 Page 1 of 2
occupation as has been agreed between the parties. The affidavit to be filed by the Respondent will also include a further undertaking in the above terms.
5. The petition is disposed of.
