% 18.09.2020 The hearing has been conducted through video conferencing. 1.

The present petition has been filed by the petitioner under Section 438 Cr.P.C. read with Section 482 Cr.P.C. for grant of Anticipatory bail in case FIR No. 416/2018, registered under Sections 419/420/120B/34 IPC at Police Station Sarita Vihar, New Delhi.

It is not in dispute that the total cheated amount in the present case is Rs.1,42,600/- and accused Satyam Kumar and Kumar Shivam had paid an amount of Rs.1,50,000/- to the complainant at the time of their releasing on bail.

The role of the aforesaid accused persons is more than that of the petitioner herein and no further custodial interrogation is required. 4.

Accordingly, the SHO/IO concerned is directed that in the event of arrest, the petitioner/applicant shall be released on his furnishing a personal BAIL APPLN. 2339/2020

bond in the sum of Rs.15,000/-. The petitioner shall cooperate with the investigation and make himself available for interrogation by police officer, as and when required.

Before parting with the order, it is relevant to mention that nothing contained in this order shall be construed as an expression on the merits of the case.

The petition is, accordingly, allowed and disposed of. 7.

Copy of this order be transmitted to SHO/IO concerned for necessary compliance.
