With the consent of the parties and without prejudice to their rights and contentions, the instant appeal stands allowed with the following order. (i) The impugned order dated 16.03.2025 stands set aside. (ii) The Tribunal shall be at liberty to deal with the application afresh under Section 17(1)(ii)(e) of the Arbitration and Conciliation Act, 1996, in accordance with law. (iii) All rights and contentions, including the maintainability of the aforesaid application itself, are left open.
