% 27.07.2018 I.A.No.9767/2018 Present application has been filed under Order XXIII Rule 1 CPC for withdrawal of the present suit in view of the settlement arrived at between the parties vide memorandum of understanding dated 13th July, 2018.

Learned counsel for the parties state that in view of the aforesaid memorandum of understanding, the present case has been settled and both the parties undertake to abide by the terms of the memorandum of understanding dated 13th July, 2018. In view thereof, the plaintiff is permitted to withdraw unconditionally the present suit.

Since in the present case, evidence has not been tendered, the

Registry is directed to refund the court fee in accordance with Section 16A of the Court Fees Act.
