The present writ petition has been filed by six (6) petitioners, who are occupants of flats on the different floors of the property bearing No. 16-A, Hari Nagar, Ashram, New Delhi (hereinafter 'subject property'), seeking grant of separate electricity connection to their respective flats. 2.

The petitioners had initially approached the respondent no.1/BSES seeking grant of electricity connections for their respective flats in the subject flats, which was denied on account of the property being 'booked/unauthorised'. Being aggrieved, the petitioner no.1 herein filed a complaint before the Consumer Grievance Redressal Forum ('CGRF'), which was decided vide order dated 25th July, 2023, holding that the electricity connection had rightly not been released in favour of the petitioners, as the subject property stood booked by MCD. further directed the respondent no.1 to consider the request of the petitioners in the event that clearance of the subject property was obtained from MCD. 3.

The petitioners have placed on record sale deeds to show that they are the bona fide purchasers and owners of the subject flats (Annexure P-1 to the writ petition).

The petitioners have also placed on record a communication dated 21st June, 2024 issued by the respondent no.2/MCD stating that the subject property has not been booked by MCD (Annexure P-5 to the writ petition). 5.

In any event, merely because a property has been booked by MCD, the same cannot be reason to deny the petitioners electricity connection. Reference in this regard may be made to the judgement of this Court 13th November 2025 in W.P.(C) 7618/2023 titled 'BSES Yamuna Power Limited v. Bhagwanti'.

Having heard the counsel for the parties, the present writ petition is disposed of subject to the following directions:- i.

The petitioners shall apply for a fresh individual electricity connections with the respondent no.1/BSES RPL. ii.

Subject to the fulfilment of all codal and commercial formalities, the respondent shall grant electricity connection. iii.

The petitioner will pay the current consumption charges in accordance with the bills raised by respondent no.1/BSES RPL from month to month.
