Heard learned counsel for the parties.

This intra-court appeal challenges the order dated 15.04.2026 whereby, W.P.(C) 4182/2026 filed by the appellant has been dismissed by the learned Single Judge on the ground that this Court at Delhi does not have the territorial jurisdiction.

Learned counsel for the appellant has drawn our attention to various orders passed in several writ petitions, where the issue raised was the same, as was raised by the appellant while filing the writ petition. One such order is dated 24.01.2023 passed by the learned Single Judge in W.P.(C) 12703/2021 whereby, the said writ petition has been disposed of with the liberty to the petitioner of the said writ petition to approach the Empowered Committee by way of a representation under the Scheme for a clarification on the question whether the said petitioner would qualify as an industrial unit for consideration under the Scheme.

The learned Single Judge has further observed that the representation on behalf of the said writ petitioner shall be filed within 30 days and the Empowered Committee shall take a decision within 04 months. 5.

It has been urged by learned counsel for the appellant that the instant appeal may also be disposed of by giving liberty to the appellant to appear before the Empowered Committee for redressal of its grievances, as has been done by the learned Single Judge in the order dated 24.01.2023 passed in W.P.(C) 12703/2021.

Learned counsel for the respondent opposes the said prayer, however, we are of the opinion that in view of the innocuous nature of the prayer made by learned counsel for the appellant, this appeal can be disposed of by permitting the appellant to seek redressal of his grievances by way of approaching the Empowered Committee.

Accordingly, without expressing any opinion on the issue of territorial jurisdiction and observing that the said issue can be decided in an appropriate case, we dispose of the instant appeal along with all pending applications with the liberty to the appellant to approach the Empowered Committee by way of making a representation under the Scheme for redressal of its grievances.

The appellant shall make the said representation within a period of 30 days from today and in case, any such representation is made, the Empowered Committee shall take a decision within 04 months thereafter.
