After hearing arguments for some time, learned counsel for petitioner, without prejudice to its rights and contentions, does not press the present petition. He, however, also supplements that since an issue with respect to the limitation has already been framed by the learned Trial Court, learned Trial Court may be requested to answer the abovesaid issue at appropriate stage, without being influenced or prejudiced by its own order dated 20.12.2024. 2.
The petition is dismissed as not pressed.

All the rights and contentions of the parties are reserved. 4.
It is also clarified that issue of limitation which is, even otherwise, stated to be a mixed question of fact and law, would be answered in terms of the evidence adduced by the parties and the learned Trial Court, while deciding any such issue, would not get prejudiced by its own order dated 20.12.2024.
