O R D E R

% 09.09.2020 [Court hearing convened via video-conferencing on account of COVID-19] 1.

Mr. Prateek Gupta enters appearance on behalf of the defendants. 1.1 Mr. Gupta says that he has filed his Vakalatnama and that the Registry has accorded him, in that behalf, diary no. 741551/2020. 1.2 Furthermore, Mr. Gupta says that he has instructions to convey to the Court that in view of the arbitration agreement obtaining between the parties, the defendants would have no objection if this Court were to appoint an arbitrator in the matter.

Mr. S.D. Singh, who appears for the plaintiff, submits likewise. 3.

Accordingly, Mr. G.P. Thareja, former Additional and District Judge [Mob. +91- 9899664642] is appointed as the sole arbitrator in the matter. 4.

Before entering upon reference, the learned arbitrator will file a disclosure statement in terms of the provisions of the Arbitration and Conciliation Act, 1996 [hereafter referred to as the "1996 Act]. CS (COMM) 345/2020 1/2 By:VIPIN KUMAR RAI 10:58:34

4.1 Learned arbitrator will be paid his fees in terms of the Fourth Schedule of the 1996 Act.

The parties and their counsel will appear before the arbitrator, albeit via the video-conferencing mechanism, on 14.09.2020 at 3.00 P.M. 5.1 In case the aforementioned date is not convenient, the learned arbitrator will fix another date, which will be proximate to the date fixed by the Court, albeit, with consent of the parties and their respective counsel. 6.

Needless to add, the parties will be at liberty to move an application before the learned arbitrator for interim relief as well. 7.

Consequently, the suit and the pending application(s) are disposed of in the aforementioned terms.
