O R D E R

% 28.04.2025 1.

Pursuant to the previous order dated 24th April 2025, counsel for the respondent appears and states that they have now complied with the said order and the authorities have passed an order dated 25th April 2025, extending the contract period of the petitioner's catering unit for a period of three months with effect from 20th February 2025. 2.

Pursuant to the said order, which has now been notified to the petitioner, the catering unit has now restarted with effect from yesterday i.e. 27th April 2025.

Counsel for the petitioner, however, contends that the extended period of the licence was over on 19th February 2025, and despite the order of 18th July 2024 in W.P.(C) 3366/2024, the extension was not granted by the respondents, forcing them to shut down the catering unit on 19th February 2025.

been passed for extension, thereby depriving them of about two months of livelihood and business, which was a legitimate expectation arising out of order dated 18th July 2024.

The Court is of the opinion that in these circumstances, considering there has been non-compliance of the orders of this Court and requisite orders were not passed in time from July 2024 to February 2025 requiring simpliciter extension required for three months, the said order of 25th April 2025, granting extension of three months on account of dies non period, will be effective from the date of the passing of the order 25th April 2025 for a period of three months.

The non-compliance by the respondents cannot deprive the petitioner of their legitimate right which had accrued in their favour pursuant to order dated 18th July 2024, which was not appealed against by the respondents and, therefore, had become final.

In these circumstances, the Court is not passing any further orders regarding the inaction by officers of the respondent, aside from the directions that they will issue a revised order tomorrow stating that the extension will be applicable from 25th April 2025 for three months. 8.

Mr. Tara Chand Meena, ACM, Northern Railway, is present in Court today and is being apprised of the directions which have been passed. 9.

Petition is, therefore, disposed of with the aforesaid directions. 10.

Copy of the order be given 'dasti' under the signatures of the Court Master.
