Present petition has been filed under section 439 Cr.P.C. read with section 482 Cr.P.C. for grant of bail in pursuance to FIR No. 308/2020 registered at Police Station Tigri for the offence punishable under section 307/34 IPC.

With the consent of counsel for the parties, the present petition is taken up for final disposal.

Learned APP accepts notice on behalf of State and has opposed the present petition by stating that petitioner is a habitual offender and involved BAIL APPLN. 2388/2020
in three other cases, if he is released on bail, he may get involved in other offences.

It is not in dispute that petitioner is in JC since 04.07.2020. The injuries sustained by the complainant are simple in nature and were discharged from hospital on the same day. Moreover, the complainant has filed an affidavit stating that he has no objection if the petitioner is released on bail. 8.
However, without commenting upon the merits of the case, I am of the view that petitioner deserves bail.

Accordingly, he shall be released on bail on his furnishing a personal bond in the sum of Rs.15,000/- with one surety of the like amount to the satisfaction of the Trial Court.

The Trial Court shall not get influenced by the observations made by this Court.

The petition is accordingly, allowed and disposed of. 12.
