CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 06.04.2018 Respondent no. 2 Ms. Chetna Kumari is present in Court along with her counsel and accepts notice. She has been identified by HC Devender Kumar of police station Uttam Nagar.
Respondent no. 2 admits having settled the matter with petitioner of her own free will, voluntarily and without any undue force, pressure or coercion before the Mediation Centre, Dwarka Courts, New Delhi on 26th July, 2017. Respondent no. 2 submits that she has no objection in case FIR is quashed. Affidavit of respondent no. 2 is also on record at pages 17-19.
Keeping in view the settlement arrived at between the petitioner and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR No.402/2016 under Section 354(A) IPC registered at police station Uttam Nagar and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J.
