The present writ petition has been filed seeking setting aside of the impugned judgment dated 27th March, 2026, passed by the Appellate Tribunal, MCD.

At the outset, counsel appearing on behalf of the respondent/MCD raises a preliminary objection with regard to the maintainability of the present petition. She submits that the impugned order is appealable before the District Judge in terms of Section 347-D of the Delhi Municipal Corporation Act, 1957.

In view thereof, counsel seeks to withdraw the present petition with liberty to approach the appellate authority.

Accordingly, the present writ petition stands disposed of with the aforesaid liberty.

No coercive steps shall be taken for a period of ten (10) days in order for the petitioner to approach the appellate authority.
