I have perused the statement of Sahwaz Raza under Section 161 Cr.P.C. in which the role of the present applicant is not only of hitting the brick on the head of the uncle of deceased, but also of exhorting other accused persons to kill the deceased. The matter is still under investigation and even the process under Section 82 Cr.P.C. has been initiated against the applicant.

Keeping in view the nature of offence and stage of investigation, there is no cogent ground to grant anticipatory bail. Accordingly, the petition/application is dismissed. Pending, application if any, also stands disposed of.
