The present petition assails a demolition notice dated 27.03.2025, issued by the respondent no.3, which seeks to demolish the residential homes of the petitioners.

Learned counsel for the petitioners and learned counsel for the respondents, who appears on advance notice are in agreement that the very same demolition notice had been the subject matter of consideration by a Coordinate Bench of this Court in a batch of matters1 .

In order dated 15.04.2025, passed in W.P.(C) 4687/2025 [Meenakshi Kapoor v. Govt. of NCT of Delhi] and connected matters, a Coordinate Bench of this Court, directed as under:

"7. Having regard to the aforesaid submissions, the petitions are disposed of, with the following directions:

(a) The demarcation report of the land in question be supplied to the petitioners, through their counsel, within one week from today.

(b)The petitioners may file applications under the Indian Forest Act, 1927, before the Additional District Magistrate/Forest Settlement Officer within a period of three weeks thereafter. (c) The Forest Settlement Officer will dispose of the petitioners' applications in accordance with law, by way of a speaking order.

(d) Until the applications are disposed of, the respondents are directed not to take any further action in terms of the impugned demolition notice."

Subsequent writ petitions bearing nos. W.P.(C) 4988/2025 [Asha Jain v. Govt. of NCT of Delhi & Ors.] and W.P.(C) 4990/2025 [Aashishanand Parmanand Wadhwani v. Govt. of NCT of Delhi & Ors.] filed by another set of petitioners, assailing the same notice were also disposed of, relying upon the above, vide a common order dated 21.04.2025. 7.

The said order dated 21.04.2025, passed by a Coordinate Bench of this Court, directed as under:

"5. Learned counsel for the petitioner in W.P.(C) No. 4988/2025 submits that the respondents must also be bound by the decision of the Supreme Court in In Re: Directions in the matter of demolition of structures [WP (C) 295/2022 and connected matters, decided on 13.11.2024]. As the direction has already been given for disposal of their representations in accordance with law, naturally all applicable judgments of the Supreme Court will also have to be followed." 8.
