Proxy counsel appearing on behalf of Mr. Raja Ranjan, Advocate submits that they have been engaged only recently as petitioner's counsel in this matter and requests for accommodation as vakalatnama is still to be filed. 2.
Mr. Anjaneya Mishra, Advocate, who had last appeared on behalf of petitioner, requests and is accordingly discharged from this matter. 3.
An objection is raised by counsel for complainant on the basis that anticipatory bail granted to petitioner by order dated 12th March 2024, by this Court be withdrawn, in light of the fact that petitioner has not deposited Rs. 1 crore, in terms of that order, as a pre-condition for grant of anticipatory bail. A perusal of record would show that on 12th March 2024, anticipatory bail was granted to petitioner subject to him depositing Rs.1 crore, in installments, which admittedly has not been done. Thereafter matter was listed before this Court on office note for non-compliance of the said order by the petitioner. Pursuant to Supreme Court's order dated 18th July 2024 whereby SLP preferred by petitioner was dismissed, petitioner moved the instant application seeking modification of order dated 12th March 2024. 5.
In these facts and circumstances, it is made clear that anticipatory bail granted to petitioner on 12th March 2024, is not available to him. 6.
