% 25.04.2025 After making some submissions, learned counsel appearing for the appellant seeks leave to withdraw the present regular first appeal challenging the order and preliminary decree dated 16.11.2024 passed by the learned District Judge-03, East-District, Karkardooma Courts, Delhi in suit bearing CS No.39/2022, with liberty to challenge the final decree that would come to be passed in the subject suit and to take all objections in the appeal challenging the final decree.

In view of the above, the appeal is disposed-of as withdrawn with liberty as prayed-for, without making any observations on the merits of the matter.
