By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioners seek quashing of FIR No.313/2023 dated 10.06.2023 registered at PS: G.T.B. Enclave, Delhi under Sections 354/354A of the Indian Penal Code, 1860 (IPC) as also all proceedings emanating therefrom, in view of the Mediation Settlement dated 06.12.2025 [Annexure P2] arrived between the petitioner nos. 1 and 2 and the respondent no.2, which is accompanied by their respective proofs of identity.

Issue notice. Learned APP for the State accepts notice and submits that he has no objection to the quashing of the aforesaid FIR. 3.
Respondent no.2, present in Court, also accepts notice and affirms the terms of the aforesaid comprehensive Mediation Settlement dated 06.12.2025, whereby out of the total settlement amount of Rs.6,00,000/-, the petitioners have already paid her a sum of Rs.4,00,000/- and for the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
remaining amount of Rs. 2,00,000/-, two Demand Drafts being DD No.931311 dated 16.04.2026 (Punjab National Bank) and DD No.931314 dated 17.04.2026 (Punjab National Bank) of Rs.1,00,000/- each, have been handed over to the respondent no.2 today as full and final settlement. 4.
The petitioners and the respondent no.2, present in Court, as well as their credentials, as on record, have been identified by the IO. 5.
Upon consideration of the existing facts and the overall events unfolding in their entirety, even though this Court is mindful that the present FIR No.313/2023 dated 10.06.2023 registered at PS: G.T.B. Enclave, Delhi under Sections 354/354A of the IPC, however, this Court is inclined to quash the present FIR in exercise of its inherent powers under Section 528 of the BNSS, particularly, since the respondent no.2 is willing to bring closure to the present proceedings and has given her affidavit to the aforesaid effect.

Respondent no. 2 intends to end all disputes with the petitioner herein qua which, their respective affidavit(s) to that effect have been annexed herewith. As such, following the law laid down by the Hon'ble Supreme Court in Jitendra Raghuvanshi & Ors. vs. Babita Raguvanshi & Anr. (2013) 4 SCC 58, Gian Singh vs. State of Punjab & Anr. (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr. (2014) 6 SCC 466, since there is nothing left to corroborate and prove the case of the prosecution, continuation of the aforesaid FIR against the petitioners will be an exercise in futility.

Accordingly, the present petition is allowed FIR No.313/2023 dated 10.06.2023 registered at PS: G.T.B.
