The petitioners have filed the present petition, inter alia, praying that FIR No. 08/2019 under Section 420 of the IPC registered with PS Vijay Vihar and all proceedings emanating therefrom, be quashed. 2.

The FIR in question was registered at the instance of respondent no. 2. Respondent no. 2 is present in Court and is identified by the Investigating Officer and his counsel. He states that he has resolved all disputes with the petitioners and has entered into a Settlement Agreement dated 03.05.2019 with the petitioners. A copy of the said Agreement is placed on record. He acknowledges that he has received a sum of ₹35 lakhs in full and final settlement of all his claims.

The learned counsel appearing for the petitioners, states that petitioner no.1 is not present in Court as his daughter has met with an accident. He, however, states that he has instructions on behalf of the petitioners that they have no grievances against respondent no.2 and the petitioners have performed their part of the obligations in terms of the compromise agreement dated 03.05.2019.

In view of the statement made by respondent no.2, this Court considers it apposite to allow the present petition and quash the FIR. 5.

In view of the statements made before the Court, the petition is allowed and FIR No. 08/2019 under Section 420 of the IPC registered with Police Station Vijay Vihar, Rohini, Delhi and all proceedings emanating therefrom, are quashed.

Respondent no.2 shall sign this order as an acknowledgment of the statements recorded herein.
