Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') (old Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.PC'), has been filed on behalf of the Petitioners, for quashing the Summoning Order dated 20.07.2023 of learned Metropolitan Magistrate, South East District, Saket, Delhi in CR Case No. 257/2021 arising out of FIR No. 235/2019 dated under Section 354/354B/509/34 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Lajpat Nagar, Delhi and all the consequential proceedings emanating therefrom, in terms of the Settlement dated 03.08.2025.

It is submitted that on 10.07.2019 at the afternoon time, the Petitioner came out and started to got Vimhans Hospital for the consultation of doctors on the way, there is PGDAV College and she though that she should accompany with her son. As the Petitioner walked at some distance and reached out of the College, Mahipal, Santram and Anantram were coming towards them and started to used abusive language and bad words. Thereafter, he assaulted with his hand on her chest with malafide intention. Somehow, they rescued themselves from them. There were nine FIRs involved out of which, four FIRs have already been settled. 5.

On the Complaint of the Petitioners, FIR No. 235/2019 under Section 354/354B/509/34 of IPC, got registered at Police Station Lajpat Nagar, Delhi.

It is submitted that the FIR was a consequence of the family disputes between the Complainant and the Petitioners. It is stated that the Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Memorandum of Settlement (MOU) dated 03.08.2025. In the Settlement, it was inter alia settled between the parties that there is a common baithak/piece of land pertains to all the parties and the partition will be executed amciably by all the members of the families. It is also settled between the parties that they shall not institute any Criminal litigation inter se of any kind in any forum hereinafter, against each other.

Today, both the parties are present in the Court and state that they have no objection if the FIR is quashed.
