The petitioner is presently incarcerated in Central Jail No. 2, Tihar Jail, New Delhi, pursuant to his conviction by the learned Trial Court vide judgment dated 15.04.2002, for offences punishable under Sections 302 and 34 of the Indian Penal Code, 1860, in connection with FIR No. 106/1998 registered under Sections 302/34 IPC at Police Station Nabi Karim. A sentence of life imprisonment was imposed upon the petitioner by order on sentence dated 17.04.2002. He has filed the present petition seeking the following reliefs:

"a) Issue a writ in the nature of Mandamus giving direction(s)/order(s) to the respondent for confinement/transfer of the petitioner to Semi Open-Prison, in FIR No. 106/1998, U/s 302/34 IPC, P.S. Nabi Karim;

b) Pass such further order(s) as this Hon'ble Court deems fit and proper."

Mr. Sanjeev Bhandari, learned Additional Standing Counsel for the State, appears on advance notice, and submits that the present petition shall be treated as a representation before the competent authority and an appropriate decision thereon shall be taken within a period of four weeks from today. He further submits that the decision so taken shall be duly communicated to the petitioner within one week thereafter. 3.

In view of the aforesaid, no further orders are sought in the present writ petition at this stage.

The present petition, alongwith pending application, accordingly, stands disposed of in terms of the submissions made by Mr. Bhandari, while leaving the rights and remedies of the petitioner open in accordance with law.

A copy of this order be communicated electronically to the concerned Jail Superintendent for information and necessary compliance.
