The learned counsel for the applicant wishes to place reliance on the statement of PW-4 (ASI Mange Ram) in support of the present application.

The learned APP points out that the said statement was recorded post the rejection of the application filed by the petitioner seeking bail before the learned Trial Court. He submits that it will be in the fitness of things that the petitioner first files a fresh application before the learned Trial Court before relying upon the abovesaid statement before this Court.

At this stage, the learned counsel for the applicant prays for leave to withdraw the present bail application with liberty to move an appropriate application before the learned Trial Court. 4.
