By way of the instant petition, petitioners seek quashing of FIR bearing No. 103/2018, registered at Police Station Uttam Nagar, Delhi for the commission of offences punishable under Sections 448/420/468/471/ 120B/174A/34 of the Indian Penal Code, 1860 (hereafter 'IPC'). 4.

The petitioners and respondent no. 2 are present before this Court and have been identified by the Investigating Officer (IO) concerned from Police The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Brief facts of the present case are that the complainant had made a complaint before the Police Station Uttam Nagar, Delhi regarding illegal possession of her plot bearing No.C-704, J.J. Colony, Shiv Vihar, Delhi and installation of electric meter by making fake papers by one Mr. Amit Lohar. It is alleged that the petitioner had threatened the complainant to leave the possession of her plot. On the basis of the aforesaid allegations, the present FIR came to be registered. After investigation, the chargesheet had been filed before the concerned Court. During the pendency of the present case, with the intervention of respectable persons of the society, both the parties had amicably settled their dispute vide Memorandum of Understanding (MoU) dated 05.07.2024.

The learned APP for the State brings to the notice of this Court that petitioners named Ashok Kumar and Manoj Kuamr have been declared Proclaimed Offender by the learned Trial Court, and therefore, this Court may quash the present FIR against the petitioners herein. 7.

On a query made by this Court, respondent no. 2 who has been identified by the concerned IO, has categorically stated that she has entered into a compromise with the petitioner out of her own free will and without any pressure, coercion or threat. It is also stated by respondent no.2 that the entire dispute has been amicably settled between the parties vide Memorandum of Understanding (MOU) dated 05.07.2024 and that she has no objection, if the present FIR is quashed.

The statement of the parties to the said effect had been recorded by the learned Joint Registrar (Judicial) on 25.04.2025. 9.

In view of the above facts that the parties have amicably resolved The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

their differences out of their own free will and without any coercion, this Court is of the opinion that no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. Moreover, there is no legal impediment in quashing the FIR in question. 10.

Accordingly, FIR bearing No. 103/2018, registered at Police Station Uttam Nagar, Delhi for the commission of offences punishable under Sections 448/420/468/471/120B/174A/34 of IPC and all the consequential proceedings emanating therefrom are quashed.

It is clarified that the proceedings qua petitioners named Manoj Kumar and Ashok Kumar will continue before the learned Trial Court, as per law.

Accordingly, the present petition stands disposed of. Pending application, if any, also stands disposed of. 13.
