It is submitted by counsel for the petitioners that there are cross FIRs filed by the parties against each other. The petitioners and the respondent no.2/complainant belonged to same locality and now with the intervention of well-wisher and friends they have compromised the matter amicably in both the FIRs. Cross FIR bearing No.900/2014 under Sections 323/354/354B IPC has already been quashed vide order dated 14.12.2015. Moreover, the petitioner no.1 is a senior citizen. The respondent No.

2/complainant is present in person (duly identified by the Investigating Officer of the case) and submits that she has amicably resolved all disputes with the petitioners voluntarily without there being any threat, coercion or pressure of any sort as both the parties are residing in the same locality. As such it is submitted that in view of the amicable settlement between the parties, she does not want any action against the petitioners and does not have any objection to quashing of the instant FIR.

of FIR.

Keeping in view the facts that the parties have compromised the matter with each other amicably, no useful purpose would be served by continuing the criminal proceedings against the petitioner, which will only be an exercise in futility and wastage of precious time of the Court. Further, quashing of such proceedings on account of compromise would bring about peace and tranquillity in the society and would also secure the ends of justice.

Accordingly, the petition is allowed and the FIR No.899/2014 registered at Police Station South Rohini,, Delhi under Sections 323/354A(1)427/34 IPC and consequent proceedings emanating therefrom are hereby quashed subject to payment of Rs.10,000/- as costs to be deposited by the petitioners with Delhi High Mediation & Conciliation Centre within two weeks from today. Copy of receipt of deposit of costs be placed on record.

The petition stands disposed of accordingly.

A copy of this order be given dasti to counsel for the petitioners. SUNITA GUPTA, J FEBRUARY 26, 2016
