In view of the statement made by the learned counsel for the respondent, the present appeal stands abated and the same is hereby dismissed.

The amount of compensation deposited by the appellant with this Court in compliance of the impugned judgment-cum-award dated 29.05.2007 be released to the respondent forthwith with accrued interest.
